GRETNA – A Kenner Olive Garden restaurant is being sued by a woman who claims she was injured in a fall out of a rolling chair on its premises.
Lois Fisher filed suit against Olive Garden, Darden Restaurants and Liberty Mutual Insurance Company in the 24th Judicial District Court on April 21.
Fisher claims she was seated at a table located at the Olive Garden restaurant in Kenner and had finished eating when she went to stand up and the chair, which had wheels on the bottom of its legs, rolled out from beneath her and she fell to the floor. The plaintiff alleges she suffered serious personal injuries in the fall including to her pinkie finger.
The defendant is accused of failing to monitor the building and its premises, failing to properly inspect the building, failing to train personnel, failing to take action to check the stability of the chairs, failing to explain the chairs had wheels and could roll out from under the plaintiff and failing to exercise due caution.
An unspecified amount in damages is sought for medical expenses, pain and suffering, psychological damage, emotional distress and loss of enjoyment of life.
