GRETNA – A local police department is being sued after one of its officers allegedly ran into a car, injuring numerous children, during the scope of his employment.
Amber Brantley, Dawn McMillion, on behalf of her minor children, and Mario Henderson Sr. and Bridget Henderson, on behalf of their minor children, filed suit against Kenner Police Department, The City of kenner and Zachary Dubourg in the 24th Judicial District Court on May 12.
Brantley alleges that she was driving with the children of the Hendersons and McMillion in her car on Sept. 15, 2013 and were stopped at a red light at the intersection of Williams Boulevard and Vintage Drive in Kenner when a Kenner Police Department car driven by Dubourg ran into the rear of their vehicle. The plaintiffs allege that the occupants of the vehicle were injured in the accident.
The defendant is accused of failing to see what should have been seen, operating a vehicle in a careless and reckless manner, failing to keep a vehicle in control, following too closely and improper starting.
An unspecified amount in damages is sought for physical pain and suffering, mental anguish, permanent disability, medical expenses, loss of income, loss of earning capacity, loss of enjoyment of life, property damage and towing and storage of vehicle.
The plaintiffs are represented by W. Patrick Klotz of New Orleans-based Klotz & Early.
The case has been assigned to Division D Judge Scott U. Schlegel.
