FedEx sued by nursing home resident who claims worker dropped packages on him

GRETNA – A corporate parcel service is being sued by a nursing home resident who claims he was injured when a delivery man tripped over his wheelchair and dropped several packages on him.

Eugene H. Klein filed suit against John Doe and FedEx Freight Inc. in the 24th Judicial District Court on June 6.

Klein asserts that on July 29, 2013 a FedEx employee was delivering packages to the Waldon Nursing Home located at 2401 Idaho Ave. in Kenner. The plaintiff claims that the unknown employee tripped over his wheelchair and dropped several packages that violently crashed onto his leg and ankle. Klein contends he received severe injuries in the incident.

The defendant is accused of failing to maintain a proper lookout, failing to maintain reasonable and proper control, failing to properly secure packages in transit and overloading a hand cart.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish, loss of enjoyment of life, disfigurement, disability and medical expenses.

Klein is represented by David H. Hanchey of New Orleans-based Dudley Debosier PLC.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
