COVINGTON – A Slidell woman is suing Sprint after a customer service employee allegedly downloaded private, personal photos from her cell phone and posted them to a public website.
Rebecca Ficarra, of Slidell, filed suit against Sprint Communications Co LP, Sprint Solutions Inc, Lipsey Communications LLC, Connectivity Source Properties LLC and John Does 1, 2, and 3 in the 22nd Judicial District Court.
Ficarra states that after bringing her phone to a Sprint store for repairs and assistance, she was informed by a friend that some of her private photos had been published on the internet website yougotposted.com. The plaintiff alleges that the Slidell police sourced the images to Sprint employee Matthew Koonce and contends that Koonce saved the images without permission during the time that he had possession of her phone.
The plaintiff accuses the defendants of breach of contract, arguing that the defendant improperly utilized the agreement for the provision of service. The plaintiff also charges the defendant with negligent supervision of employees, arguing that it was Sprint’s duty to supervise and train its employees. The defendants are further accused of gross negligence for failing to reasonably protect the private information of a client.
An unspecified amount in damages is sought by the plaintiff for severe mental anguish, embarrassment, humiliation and attorney’s fees.
The plaintiff is represented by Timothy W. Porter, of Jackson, Miss. firm Porter and Malouf.
The case has been assigned to Division C Judge Richard A. Swartz.
