Man sues numerous corporations after contracting mesothelioma

NEW ORLEANS – A man who suffers from mesothelioma has filed suit against numerous corporations for their alleged concealment of the health hazards inherent in asbestos products, which he claims led to his contraction of the terminal illness.

Jimmy D. Hall Sr. filed suit against Anco Insulations Inc., CBS Corp., Foster Wheeler Energy Corp., General Electric Company, McCarty Corp., Taylor-Seidenbach Inc., Agrico Chemical Company of Delaware, AMAX Metals Recovery Inc., BASF Corp., The Dow Chemical Co., Ethyl Corp., Exxon Chemical Louisiana LLC, Exxon Mobil Corp., Freeport Sulphur Co., Georgia Pacific LLC, The Goodyear Tire & Rubber Co., Hercules INC., Honeywell Int., Humble Oil Company LLC, Jacobs Engineering Group Inc., Novartis Corp., Occidental Chemical Corp., Payne & Keller Company Inc., Pharmacia Corporation, Shell Oil Co. and Turner Industries Group LLC in the Orleans Parish Civil District Court on May 7.

The plaintiff claims each of the defendants named had a responsibility to provide the plaintiff with adequate warnings concerning the hazards of inhaling, exposure to, and handling products containing asbestos, yet they did not adequately fulfill this responsibility.  The plaintiff asserts that had the defendants warned the plaintiff of the hazards it would have prevented him from contracting mesothelioma, an irreversible and terminal cancer.  The plaintiff claims each of the defendants knew, should have known, or are strictly liable of the hazards involved in handling the asbestos-contained products.

The defendants are accused of knowing and concealing the health hazards inherent in the asbestos-containing products they were selling, which was handled by the plaintiff and was a direct cause to the plaintiff contracting malignant mesothelioma.  Other defendants included are accused of negligently concealing the dangers of working with asbestos-containing products or strict liability for the plaintiff's damages.

The plaintiff is seeking an unknown amount in damages for medical costs, lost earnings, mental suffering, physical pain and suffering, loss of consortium, and loss of quality of life.

The case has been assigned to Division I Judge Piper D. Griffin.
