GRETNA – Parents are suing a local pet and garden store after their daughter allegedly broke her foot and ankle after slipping and falling.

Ron and Wendy Benoit, individually and as parents of their minor daughter, filed suit against Jefferson Feed and Garden Supply Company Inc., Bankers Insurance Company, Benedetti Properties LLC, Neighborhood Pet Market by Jefferson and George Benedetti in the 24th Judicial District Court on June 27.

The Benoits contend that their daughter was a customer at the Jefferson Feed Pet & Garden Center located at 4421 Jefferson Hwy. in Jefferson when she stepped on water pooled on an uneven floor and fell. The plaintiffs claim that after the incident an employee admitted that several other patrons had fallen in the same spot in the past and the issue had not been fixed. The Benoits allege that their daughter broke her foot and ankle and sprained her knee in the incident.

The defendant is accused of creating a trap, allowing a hazardous condition to exist and failing to repair the premises.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, anxiety, humiliation, physical impairment, disability, loss of enjoyment of life, invasion of privacy and medical treatment.

The Benoits are represented by attorney Richard A. Thalheim of Thibodaux.

The case has been assigned to Division A Judge Raymond S. Steib Jr.

Case no. 739-874.
