Couple sued over alleged non-payment of $53K after home elevation

Breach of contract

GRETNA – A construction company is suing a couple who allegedly did not pay for elevating their home.

ASJ Construction Group LLC filed suit against Rosia and Herbert Holmes in the 24th Judicial District Court on July 7.

ASJ Construction Group LLC claims it entered into a construction contract with the Holmeses on Jan. 10, 2011 to elevate their home located at 269 Capitol Dive in Avondale at a cost of $128,000. The plaintiff asserts that after a change order the price was changed to $131,670 and the defendants made an initial payment of $50,000 on Feb. 16, 2011 and a second payment of $28,544 on June 3, 2011 and that after the work was substantially completed on June 3, 2011 an invoice was sent by the plaintiff in the amount of $53,126.

ASJ Construction Group LLC contends it has never received final payment from the defendants.

The defendant is accused of breach of contract.

Damages in the amount of $53,126 plus attorney’s fees are sought by the plaintiff.

ASJ Construction Group LLC is represented by Jeffrey M. Siemssen of Metairie-based Nicaud & Sunseri LLC.

The case has been assigned to Division C Judge June Berry Darensburg.
