NEW ORLEANS – A woman is suing companies relevant to the ownership, operation, manufacture and insurance of an elevator in which she allegedly sustained severe injury.
Charlene Cook filed suit against Irish Channel Funding LLC, Atain Insurance Company, American Crescent Elevator Corporation and their insurer in the Orleans Parish Civil District Court on June 20.
Cook asserts that on July 19, 2013, she proceeded into an elevator located at 1630 Iberville St. in New Orleans. Upon entering the elevator, the lighting fixtures suddenly fell directly onto the plaintiff, says the suit. Cook claims that she suffered severe and disabling injuries as a result of the incident.
The defendants are accused of negligence, including failure to keep the elevator in a safe condition and allowing a dangerous condition to exist for an unreasonable length of time.
The plaintiff is seeking damages in excess of $50,000 for physical pain and suffering, past, present, and future loss of wages, future loss of earning capacity, permanent disability, mental anguish, emotional distress, medical expenses and loss of enjoyment of life.
