Contractor sued for over $22K for allegedly ordering the wrong size windows and doors

NEW ORLEANS – A couple is suing a contractor they hired to replace windows and doors upon realizing they were allegedly the wrong size.

Paulette and Jeffrey Mendler filed suit against Crescent Land Development LLC, ABC Insurance Company, Crescent Contractors LLC, and XYZ Insurance Company in the Orleans Parish Civil District Court.

The plaintiffs claim they hired the defendants to replace existing windows and doors, but when the defendants delivered the windows and doors they were not the proper size for the existing openings. The Mendlers assert they communicated to the defendants that the windows and doors needed to be the same size and code rating as the existing windows and doors and that the defendants measured the windows and doors to get the correct sizes. The plaintiffs say that the defendants have been unresponsive to their request to have their purchase price of $22,262.57 refunded.

The defendant is accused of failing to provide the plaintiff with the exact materials purchased by the plaintiff and refusing to allow the plaintiff to return the materials for a refund of the purchase price.

The plaintiffs are seeking $22,262.57 as a refund of the price they paid for the materials and an unknown amount for consequential damages due to their inability to move forward with the repair of their home due to the defendant’s actions.

Paulette and Jeffrey Mendler are represented by Brian D. Katz from the firm of Herman Herman & Katz LLC in New Orleans.

The case has been assigned to Division D Judge Lloyd J. Medley.
