NEW ORLEANS – A St. Claude mother is suing the Homer A. Plessy Charter School saying it is negligent for an injury her son suffered in tripping over a large crack on the playground.
Toryana Harrell filed suit against Arch Insurance Company, Arise Academy and the Citizens' Committee for Education, also known as the Homer A. Plessy Charter School, in the Orleans Parish Civil District Court on July 29.
Harrell claims that on Aug. 26, 2013 at the Homer A. Plessy Charter School located at 3820 St. Claude Ave. in New Orleans, her son was caused to trip and fall in a deep crack on the school's playground. Harrell alleges that her son suffered severe and disabling injuries as a result of the fall and is entitled to recover damages.
The defendants are accused of negligence, including failure to maintain a reasonably safe premises and failure to warn students and parents of the dangerous nature of the premises.
The plaintiff seeks an unknown amount in damages for physical and mental pain and suffering, medical expenses, loss of past earnings and future earning capacity, permanent disability of the body, attorney's fees and court costs.

The case has been assigned to District C Judge Sidney H. Cates.
