NEW ORLEANS – A New Orleans woman is suing the New Orleans Regional Transit Authority for allegedly failing to help her board a bus, which she claims resulted in severe permanent injuries.
Deborah D. Bordley filed suit against the New Orleans Regional Transit Authority, Transit Management of Southeast Louisiana Inc. and Veola Transportation Services Inc. in the Orleans Parish Civil District Court on Aug. 13.
Bordley claims that on Sept. 4, 2013 at the corner of Washington and South Carrolton in New Orleans, she attempted to board an RTA bus at approximately 6:30 p.m. The plaintiff asserts that the driver did not lower a platform so that she could step up easily. According to the suit, the bus’s height caused Bordley to stumble and injure her left leg.
Bordley charges that her injury is due solely to the RTA's negligence, and that she suffered from shock and severe, painful and permanent injuries as a result of the incident.
The defendant is accused of negligence, including failing to act with reasonable vigilance, failing to keep a proper lookout, and failing to lower the bus to provide a safer method of ingress.
The plaintiff seeks an unknown amount in damages for medical expenses, physical pain and suffering, mental pain and suffering, residual physical disability and impairment of function, past and current wage loss, impairment of future earning capacity, inability to pay bills and damage to her credit.
Deborah D. Bordley is represented by attorney Richard H. Barker IV.
The case has been assigned to District M Judge Paulette R. Irons.
Case no. 2014-07359.
