AT&T sues excavation company over alleged damage to buried utilities

GRETNA – An excavation company is being sued by a hone company for allegedly damaging underground utility lines.

Bellsouth Telecommunications LLC and AT&T Louisiana filed suit against Nu-Arrow Industries Inc. in the 24th Judicial District Court on July 23.

Bellsouth Telecommunications LLC and AT&T Louisiana claims that while excavating an area near 2301 Severn Ave. in Metairie, Nu-Arrow Industries Inc. damaged underground utilities they own. The plaintiffs contend that under the Louisiana Underground Utilities and Facilities Damage Prevention Law the defendants should have provided no less than 48 hours before digging in the area, but failed to do so.

The defendant is accused of failing to know what they should have known, failing to observe what should have been seen, failing to plan for the excavation and failing to maintain a safe clearance between the excavating equipment and facilities.

An unspecified amount in damages is sought for property damage, attorney’s fees, court costs and interest.

Bellsouth Telecommunications LLC and AT&T Louisiana is represented by Michael B. Alker of Mandeville-based Sutton, Alker & Rather LLC.

The case has been assigned to Division E Judge John J. Molaison Jr.
