Home elevation company sued by woman allegedly injured in fall on stairs

GRETNA – A woman who was allegedly injured after falling off her stairs is suing a home elevation company for not securing the premises.

Beverly Helmer, and Eric, filed suit against Dixie Shoring and Construction LLC, Indian Harbor Insurance Company and their insurers in the 24th Judicial District Court on Aug. 1.

The Helmers claim they contracted Dixie Shoring and Construction through the Louisiana Hazard Mitigation Program to elevate their home located at 2520 Ramsey Drive in Marrero. The plaintiffs assert that on Aug. 21, 2013 Beverly was walking up a temporary stairwell when the stairs began to wobble and she fell off of them.

The Helmers allege Beverly received severe injuries to her neck, left elbow, left knee and hip as well as bruises to her face in the incident.

The defendant is accused of failing to properly construct and maintain the stairway, failing to properly warn of the potential danger of the stairway, failing to properly inspect the stairway, failing to place handrails on the stairway, constructing and maintaining a dangerous stairway, failing to train and supervise employees and maintaining a defective premises.

An unspecified amount in damages is sought for medical treatment, suffering great pain, mental anguish, loss of sleep, loss of proper rest and medication expenses.

Helmer is represented by Leo J. Palazzo of the Gretna-based Palazzo Law Firm.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
