Contractor allegedly brought up on criminal charges for passing false checks sued after taking $363K check and abandoning project

GRETNA – A contractor is being sued for allegedly abandoning a project and spending more than $300,000 in construction funds for personal use.

Doug Stubbs Jr. and Joann Stubbs filed suit against Estess Contractors LLC in the 24th Judicial District Court on Aug. 6.

The Stubbses claims that on Nov. 21, 2013 they entered into a contract in the amount of $591,400 with Estess Contractors to build a home  on a lot located at 222 Dogwood Dr. in Kenner. The plaintiffs allege the contract was later amended to $557,843.22 and that the contractor had been paid $164,778.24 for work done on the project and that he would be paid all but a retainer of $29,570 upon final completion.

The Stubbses assert on March 6 after they submitted a check for $363,494.98 to Estess Contractors, but the project was abandoned without paying subcontractors or suppliers for the work done. On July 21, Hunter Estess the owner of Estess Contractors, was arrested for issuing worthless checks to subcontractors and suppliers. The plaintiff claims that Estess used the money they provided him for the construction of their home for personal use.

The defendant is accused of accepting payment for work that was not done, criminal conduct and breach of contract and professional duty.

An unspecified amount in damages is sought for fees to complete the home construction, attorneys' fees, penalties and cost of legal proceedings.

The Stubbses are represented by Bradford H. Walker of Metairie-based Walker Daly LLP.

The case has been assigned to Division D Judge Scott U. Schlegel.
