Winn Dixie sued for alleged customer injury in trip and fall over pallet

GRETNA – A local grocery store customer is being sued after she was allegedly injured when she tripped and fell over a pallet.

Dianze D. Lee filed suit against Winn Dixie Louisiana and Winn Dixie Montgomery LLC in the 24th Judicial District Court on Aug. 13.

Lee claims that on Dec. 11, 2012 she was shopping at the Winn Dixie Supermarket located on Veterans Blvd. in Metairie when she tripped over an empty pallet and fell face first to the floor. The plaintiff alleges the pallet was placed in such a way to be out of sight, but also be a tripping hazard. Lee asserts she was injured in the incident and had to be taken to a nearby hospital via ambulance.

The defendant is accused of failing to remove empty pallets from the store, failing to keep customers safe, failing to warn and post notice signs and failing to operate the store to prevent falls.

An unspecified amount in damages is sought for pain and suffering, mental pain, anguish, shock, emotional stress, loss income, lost wages, emergency room expenses, hospital expensesand medical treatments.

The case has been assigned to Division I Judge Nancy A. Miller.
