HVAC repairman sues after attic stairs allegedly collapse beneath him

GRETNA – A local homeowner is being sued after an HVAC repairman was allegedly injured when a set of attic stairs collapsed underneath him.

Henry Walden Jr. filed suit against Tanzley Erris Jr. and Certain Underwriters at Lloyd’s London in the 24th Judicial District Court on Aug. 14.

Walden alleges that he was at the home of Erris located at 5545 Hamerick Drive in Harvey to repair an air conditioning system on the property. The plaintiff asserts that as he was attempting to climb a set of stairs into the attic to access part of the air conditioning unit the stairs fell beneath him. Walden contends that due to the incident he received painful and serious physical and mental injuries.

The defendant is accused of failing to properly maintain the area, failing to warn guests of the danger, failing to safely maintain the attic stairway, creating and maintaining a defective condition and allowing a dangerous condition to exist.

An unspecified amount in damages is sought for pain and suffering, permanent damage, loss of enjoyment of life, medical expenses and economic damages.

Walden is represented by attorney Pierre F. Gaudin of Gretna.

The case has been assigned to Division O Judge Ross P. LaDart.
