Contractor sued by man allegedly injured in fall at own home

GRETNA – A man who alleges he was injured in a fall on his own front steps is suing a contractor, claiming it is responsible for the incident.

Derek Lemieux filed suit against Mid South Developers of LA Inc. in the 24th Judicial District Court on Aug. 18.

Lemieux claims he contracted Mid South Developers of LA Inc. to raise his home located at 3804 Cover Lane in Harvey. The plaintiff contends on Oct. 3, 2013, during the period the defendant was working on his property, he was descending the stairs in front of his home when he tripped and fell on the stairs. Lemieux contends he was seriously injured in the fall.

The defendant is accused of failing to install or raise the stairway area where the incident occurred, allowing an unsafe and dangerous condition to exist, failing to inspect and warn of the danger,

An unspecified amount in damages is sought for pain and suffering, permanent personal damage, loss of enjoyment of life, medical expenses and economic damages.

Lemieux is represented by attorney Pierre F. Gaudin of Gretna.

The case has been assigned to Division J Judge Stephen C. Grefer.
