GRETNA – A cell phone store owner is suing after its retail stock was allegedly damaged when pipes at a neighboring business burst and flooded the property.
Neil Fattah, individually and on behalf of Worldwide Imports and Exports LLC, and EZ Wireless and EZ Wirless No. 2 LLC filed suit against Mei Mao Ziao, Chopstix Buffet and Hallmark Specialty Underwriters in the 24th Judicial District Court on Aug. 18.
Fattah alleges on Aug. 19, 2013 he was operating his businesses, Worldwide Imports Exports, EZ Wireless and EZ Wireless No. 2 LLC, where he had on sale numerous cell phones and mobile devices and on that day a water leak sprung in the business located next door in the same building at Chopstix Bufffet. The plaintiff claims the water flooding and moisture damaged several pieces of inventory and made them impossible to sell.
The defendant is accused of failing to inspect and adequately maintain the building, failing exercise reasonable case in the building and not giving actual or constructive notice of the building’s water pipes leaking.
An unspecified amount in damages is sought for cost of repairing cell phones, loss of income and cost of depreciation.
