Discount Zone sued over woman’s alleged injuries in slip and fall over exposed rebar

NEW ORLEANS – A Discount Zone patron allegedly slipped and fell over rebar while walking to her car.

Wilberina Russell filed suit against Certain Underwriters at Lloyd’s, London, Spur Discount Store #3 Inc. and Blasini Family LLC in the Orleans Parish Civil District Court on Sept. 18.

Russell asserts that on Dec. 4, 2013, she was purchasing gas at the Discount Zone located at 1533 Esplanade Ave. in New Orleans. She then proceed back to her car, where suddenly, the petitioner allegedly slipped and fell on rebar jutting up from the ground.

The defendants are accused of allowing a hazardous condition to exist, failing to correct the defective steel, failing to warn of a dangerous condition, and failing to properly examine the premises for any defects.

The plaintiff is seeking an unspecified amount in damages for medical expenses, mental agony, pain and suffering, loss of wages, transportation fees and loss of enjoyment of life.

The plaintiff is represented by Robert P. Charbonnet Jr. and James S. Rees IV of Charbonnet Law Firm LLC.

The case has been assigned to Div. L Chief Judge Kern A. Reese.
