NEW ORLEANS – Patrons of Galvez Restaurant are suing the establishment after allegedly being injured when they fell through damaged flooring in a back patio.
Vic Planetta and Mark Davison filed suit against Galvez Restaurant LLC and their insurer in the Orleans Parish Civil District Court on Sept. 12.
The petitioners claim that on July 4, 2014, they were standing on the back patio of Galvez Restaurant, located at 914 N. Peters St. in New Orleans, when without warning, they allegedly fell through the wooden foundation. The plaintiffs contend they sustained severe bodily injuries requiring continual medical treatment as a result of the incident.
The defendants are accused of failing to secure the deck, failing to preserve the deck, failing to supply a safe deck for its guests, failing to warn of the defective deck and failing to use proper care.
The plaintiffs are seeking an unspecified amount in damages for mental agony, loss of sleep, loss of wages, pain and suffering, decline in future income and loss of enjoyment of life.
The plaintiffs are represented by Michael S. Brandner Jr. and Keith A. Conley of Brandner Law Firm LLC.
The case has been assigned to Div. M Judge Paulette R. Irons.
