GRETNA – A security officer at a local festival is suing after she claims she was injured when a fence fell on top of her.
Lisa Brown filed suit against Event Rental LLC, doing business under the the trade name Your Event Delivered, and their insurer in the 24th Judicial District Court on Sept. 4.
Brown asserts that she was working as a security guard, employed by L&R Security, at the Gretna Heritage Festival on Oct. 6, 2013 when a temporary fence provided by Event Rental LLC began to fall. The plaintiff claims she attempted to catch the fence to prevent it from striking her face, but it was too heavy for her to hold up and it hit both of her knees and pinned her to the ground. Brown alleges that it took multiple police officers to pull the fence off of her and that due to the incident she received severe and disabling injuries to her knees, neck and back.
The defendant is accused of improper fence construction, improper inspection, failing to maintain proper fencing, allowing dangerous and defective conditions to exist, failing to inspect danger, failing to provide a safe place for invitees to walk, failing to remedy dangerous conditions, violating applicable laws, knowing of the defects, failing to exercise reasonable care, having known the damage was foreseeable, neglecting to repair the ruin, allowing the vice to remain and failing to warn of the dangers.
An unspecified amount in damages is sought for physicians’ professional services, prescription medications, pain and suffering, loss of wages, medical expenses, permanent disability, loss of enjoyment of life and transportation costs.
Brown is represented by Seth H. Schamumburg of Favret, Demarest, Russo & Lutkewitte.
The case has been assigned to Division H Judge Glenn B. Ansardi.
