NEW ORLEANS – A popular New Orleans restaurant is suing its insurer for allegedly failing to provide appropriate coverage after Hurricane Isaac.
Jacques-Imo Cafe LLC filed suit against Underwriters at Lloyd's, London and Certain Underwriters at Lloyd's subscribing to policy number LA28867 in the Orleans Parish Civil District Court.
Jacques-Imo claims that its restaurant property located at 8324 Oak St. in New Orleans sustained damage from Hurricane Isaac's landfall on Aug. 29, 2012. The property was insured by Lloyd's from Nov. 12, 2011 until Nov. 12, 2012, says the suit.
The plaintiff asserts that Jacques-Imo's Cafe suffered interruption of business, spoilage, structural damage and extra expenses as a direct result of Hurricane Isaac. The restaurant's policy with Lloyd's was supposed to cover such losses, the suit says.
Jacques-Imo alleges it informed Lloyd's of the damage after the storm subsided, but that Lloyd's failed to respond to the incident in a timely fashion and begin the adjustment process. The plaintiff alleges that Lloyd's has failed to compensate Jacques-Imo for damages covered under the policy.
Jacques-Imo claims that Lloyd's made unreasonable demands, and refused to provide compensation for undisputed losses. The suit says that Jacques-Imo was forced to pay for repairs and various other expenses, in addition to sustaining loss of commercial income.
The defendant is accused of breach of contract and bad faith claims adjusting.
The plaintiff seeks an unknown amount in damages for the amount pursuant to their insurance policy, in addition to bad faith damages and attorney's fees.
