Furniture store customer claims head injury in couch mishap

GRETNA – A furniture store is being sued by a woman who claims she was injured when a couch she sat in slid backward causing her head to violently slam into a metal shelf.

Cinuray Rancifer filed suit against Western Heritage Insurance Company, National Furniture Outlet Inc. and Donna Cummings in the 24th Judicial District Court on Sept. 11.

Rancifer claims that on Sept. 14, 2013 she was at the National Furniture Outlet store located at 1328 Fourth St. in Westwego shopping for a sofa and mattress. The plaintiff alleges that a store employee invited her to sit on a sofa and when she did it violently slid backward and her head struck a metal shelf resulting in head and neck pain, dizziness and disorientation. Rancifer contends that she received severe and disabling injuries in the incident.

The defendant is accused of failing to properly and adequately ensure displays were safe and failing to properly and adequately warn about the hazard.

An unspecified amount in damages is sought for mental anguish, shock and fright, severe pain, partially disabling injuries, medical expenses, lost wages, inconvenience, hardship and aggravation.

Rancifer is represented by attorney Robert Matlock Hearin Jr. of New Orleans.

The case has been assigned to Division J Judge Stephen C. Grefer.
