GRETNA – A local shoring company is suing a construction company and its owner over alleged default on payment of a modular building worth more than $500,000.
Warren P. Davie and Davie Shoring Inc. filed suit against William R. Hemphill and A.F.H. Construction LLC in the 24th Judicial District Court on Sept. 11.
Davie and Davie Shoring Inc. contend that Hemphill and A.F.H. Construction LLC entered into a contract with them, signed on April 7, to purchase a modular building located in New Orleans for $510,000. The plaintiffs assert that under the contract the defendant was to pay an initial deposit of $51,000 and then within 30 days of the contract pay the remaining balance of $459,000. Davie and Davie Shoring Inc. claim that Hemphill and A.F.H. Construction LLC provided a check for the remaining balance of $459,000 on April 15, but the check was returned because the account was frozen or blocked. The plaintiffs allege that due to the check being returned the defendants are in default and still owe a balance.
The defendant is accused of breach of contract.
Damages are sought in the amount of $459,000 plus attorney’s fees and court costs.
