Contractor accused of bailing on contract, letting incomplete renovation deteriorate

Breach of contract

GRETNA – A contractor is being sued by a homeowner for allegedly not completing major renovations to his home that have resulted in further deterioration of the property.

Floyd Williams filed suit against Quality Residential Services of Louisiana and Dilia Castillo De Hernandez in the 24th Judicial District Court on Sept. 13.

Williams alleges that he entered into a contract to have Hernandez and Quality Residential Services of Louisiana provide several repairs to his home located at 4800 Babylon St. in New Orleans through August 2013. The plaintiff contends that the defendant was to do a number of projects including installing a new roof, new facial boards, fixing the concrete slab, replacing all bad wood in the interior, pressure washing and treating all windows, new plumbing, new electrical, installation of air conditioner, sheet rock and paint work, hanging doors, kitchen cabinets and shelving as well as installing toilets and vanity in the bathroom.

Williams asserts that the contract with Hernandez and Quality Residential Services of Louisiana was in the amount of $78,000 and that they began work shortly after signing the contract on June 6, 2013. However, the plaintiff claims that the defendants did not fully complete the renovations by the end of August at which time they were provided with a full list of incomplete projects. Williams alleges that after being provided with the list of incomplete work Hernandez and Quality Residential Services of Louisiana refused to provide any further work on the home despite the promise of a final payment when the work is completed.

The plaintiff contends that the defendant has refused to return to the home to complete the contract and his property has sustained further damage as a result.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for funds for another contractor to complete the contract and make repairs to deterioration.

Williams is represented by attorney Willard J. Brown of New Orleans.

The case has been assigned to Division H Judge Glenn B. Ansardi.

Case no. 742-395.
