Leaking water results in woman’s injury at in slip and fall at grocery store, lawsuit claims

GRETNA – A corporate grocery store is being sued by a woman who claims she was injured in a slip and fall on water that had leaked on the premises.

Chanel Smith filed suit against Winn-Dixie Montgomery in the 24th Judicial District Court on Sept. 23.

Smith claims that on Oct. 5, 2013 she was a customer at the Winn-Dixie grocery store located at 3623 Jefferson Highway in Jefferson when she slipped and fell in a puddle of water that had leaked on the premises. The plaintiff alleges that the incident occurred due to negligent maintenance on behalf of the defendant. Smith contends she received injuries in the fall.

The defendant is accused of failing to maintain clean premises, failing to properly repair the premises, failing to clean up leaking water immediately, failing to post warnings of the danger and failing to adequately protect the safety of customers.

An unspecified amount in damages is sought for medical expenses, loss of earnings, pain and suffering, mental anguish, emotional distress, embarrassment, humiliation, disability, impairment, disfigurement and loss of enjoyment of life.

Smith is represented by Kenny M. Charbonnet of the New Orleans-based Charbonnet Law Firm LLC.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.
