Oil change business sued by man allegedly injured in fall in pit hole

GRETNA – An oil change business is being sued by a man who claims he was injured when he fell in a pit hole while walking to his car.

Leo Oliver, and wife Sharon, filed suit against Westbank Lubrication Destination LLC, Westbank Lube and Western Heritage Insurance Company in the 24th Judicial District Court on Sept. 29.

Oliver asserts he was a customer at Westbank Lubrication Destination located at 808 Manhattan Blvd. in Harvey when he was walking to the checkout to pay for services and fell into an uncovered pit hole. The plaintiff claims he received painful and serious injuries in the incident.

The defendant is accused of failing to properly maintain the property in a safe condition, failing to inspect and learn of a dangerous and effective condition, failing to warn guests of the dangers and defects and allowing a danger and defect to exist after proper notice.

An unspecified amount in damages is sought for pain and suffering, permanent personal damage, loss of enjoyment of life, medical expenses, loss of consortium and loss of income.

Oliver is represented by attorney Pierre F. Gaudin of Gretna.

The case has been assigned to Division F Judge Michael P. Mentz.
