GRETNA – The State of Louisiana is suing a cleaning company it claims caused one of its employees to be injured after slipping and falling on a freshly cleaned floor.
State of Louisiana, Office of the Governor, Division of Administration, Office of Risk Management filed suit against Westbank ARC Inc., Employment Development Services Inc. and their insurers in the 24th Judicial District Court on Sept. 30.
The plaintiff alleges that they employed Shelia Frey as a social worker in the Jefferson Parish Human Services Authority and on Nov. 20, 2013 when she left her office and entered the hallway she slipped on the floor that had just been cleaned. The State of Louisiana contends that because it operated a workers' compensation fund for all state employees it was required to pay Frey $13,091.73 in medical benefits and $1,153.84 in indemnity benefits for the injuries she allegedly sustained in the fall.
The defendant is accused of failing to perform janitorial services they were contracted for in a workmanlike manner, failing to place a wet floor sign in the area of their work on floor in question, failing to warn of the slippery condition of the floor and failing to restrict access to the floor.
An unspecified amount in damages is sought for reimbursement for workers compensation benefits they paid out due to the incident.
The plaintiff is represented by assistant attorney general Thomas A. McGaw of the Louisiana Department of Justice.
The case has been assigned to Division G Judge Robert A. Pitre Jr.
