Pedestrian sues Jefferson Parish, utility companies over fall in hole

Trip and fall case lost

GRETNA – A pedestrian is suing Jefferson Parish and two utility companies claiming they are responsible for injuries she received in a trip and fall in a hole in a path.

Abbie Lynn Theriot filed suit against The Parish of Jefferson, AT&T Corp. and Cox Communications LLC in the 24th Judicial District Court on Oct. 2.

Theriot alleges on Oct. 13, 2013 she was walking on a pedestrian path located at Taffy Street and Ames Boulevard in Marrero that was within the work areas of AT&T Corp. and Cox Communications. The plaintiff contends that as she was walking along the pedestrian pathway the ground gave way underneath her feet and she fell face first into a concrete lined hole. Theriot assets that after falling she realized her leg was submerged in sludge and water in the hole and that she had injured her knee, ankle, lower leg and back in the incident for which she was transported to a nearby hospital by ambulance.

The defendant is accused of not properly maintaining the premises, not maintaining proper vigilance, failing to wan of the danger, failing to properly train and supervise employees, creating a trap and failing to see and not doing things that should have been done.

An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental pain and suffering, emotional pain and suffering, disfigurement, disability, impairment and loss of earnings.

Theriot is represented by Michael Brandner Jr. of the New Orleans-based Brandner Law Firm LLC.

The case has been assigned to Division D Judge Scott U. Schlegel.
