Daycare center sued by pregnant mom who fell off stairs while carrying child

GRETNA – A pregnant mother claims she and her children were injured when she fell off a set of steps at a daycare center.

Kristina Dillenkoffer, individually and on behalf of her minor children, filed suit against Marrero Day Care Center Inc. and their insurer in the 24th Judicial District Court on Oct. 6.

Dillenkoffer claims that on Feb. 24 she was six months pregnant when she was picking up her children up at Marrero Day Care Center located at 616 Avenue B in Marrero. As she was exiting the building carrying her then 18 month old son she tripped and fell violently to the concrete steps below. The plaintiff alleges she received severe and debilitating injuries including a broken tibia and fibula in her leg and her son received a broken collarbone in the incident.

The defendant is accused of failing to take all precautions to avoid the incident, knowingly allowing a defect to exist, allowing a stairwell without proper railing on the premises, failing to warn of the danger, failing to secure proper permitting, failing to construct a stairwell pursuant to code, allowing a hazardous condition and failing to timely ensure safety of customers.

An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental anguish, mental distress, lost wages, loss of wage earning capacity, permanent disability, loss of function, disfigurement, scarring and loss of enjoyment of life.

The case has been assigned to Division B Judge Cornelius E. Regan.
