Motorist sued for allegedly running over pregnant pedestrian

GRETNA – A pregnant pedestrian who was allegedly run over by a motorist is suing for injuries she claims she received in the incident.

Tiffany Gosey filed suit against Ralph Barnes and Esurance Insurance Company in the 24th Judicial District Court on Oct. 8.

Gosey asserts that on Oct. 10, 2013 she was walking along the road on the 3100 block of Alex Komman Boulevard in Harvey when Barnes, who was driving a 2011 Buick Regency insured by Esurance Insurance Company, stuck her, throwing her face down into the roadway. The plaintiff claims that she received significant injuries in the incident including to her legs, wrists, right side and face that resulted in lacerations requiring sutures. Gosey alleges the incident also made her fear for the life of her unborn child.

The defendant is accused of failing to maintain proper control of the vehicle, failing to keep a proper lookout, driving in careless manner, failing to use reasonable vigilance, traveling too close to the shoulder of the roadway, inattentiveness and failing to obey traffic laws.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, fear and anxiety over her unborn child, medical bills, scarring, disfigurement and loss of enjoyment of life.

Gosey is represented by Allan Berger of New Orleans-based Allan Berger & Associates PLC.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
