Truck driver sues over injuries from alleged fall after roadway collapses beneath him

GRETNA – A concrete mixing truck operator is suing a roadway construction company where he was making a delivery when he was allegedly hurt when the ground gave way beneath him and he fell into a hole.

Sean Bowie filed suit against Hard Rock Construction LLC in the 24th Judicial District Court on Oct. 9.

Bowie alleges that he was employed by Lafarge North America Inc. and was ordered to deliver concrete to roadway rehabilitation job site under the control of Hard Rock Construction. The plaintiff contends that as he exited his truck on the construction site the roadway collapsed beneath him and he fell into a hole. Bowie asserts he was severely injured in the incident.

The defendant is accused of failing to appropriately inspect the roadway, failing to exercise reasonable care in providing a warning for the unsteady concrete roadway and failing to do things that should have been done to avoid the accident.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish and suffering, medical expenses, loss of wages and loss of earning capacity.

Bowie is represented by C. Allen Braud II of Mandeville-based Braud & Gallagher LLC.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
