GRETNA – A customer of a local grocery store is suing after she was allegedly knocked over by a security guard chasing after a shoplifting suspect.
Penny Arnold, and husband Jude, filed suit against Inner-Parish Security Corporation in the 24th Judicial District Court on Oct. 10.
Arnold asserts that she and her husband had just finished shopping at the Rouse’s Supermarket located at 717 Celearview Parkway in Metairie on Aug. 15, 2014 and were exiting the building when an unidentified employee of Inner-Parish Security Corporation attempted to retain another customer on suspicion of shoplifting. The plaintiff claims that as they were walking by the defendant’s employee the suspected shoplifter evaded his grasp and ran into her, causing her to lose her balance, and that the security guard ran into her as he began to give chase, knocking her to the floor. Arnold alleges she received severe personal injuries in the incident to her spine, upper extremities, shoulder, back and legs.
The defendant is accused of failing to use due care, negligently chasing a suspected shoplifter, endangering customers, creating an unreasonable risk and failing to warn of an impending disaster.
An unspecified amount in damages is sought for emotional pain, mental pain, loss of physical function, loss of enjoyment of life and medical expenses.
Arnold is represented by John G. Munoz of New Orleans-based Garner & Munoz.
The case has been assigned to Division I Judge Nancy A. Miller.
Case no. 743-326.
