Winn-Dixie sued over alleged injuries to customer in slip and fall

GRETNA – A local grocery store is being sued by a customer who claims she was severely injured after slipping and falling on its premises.

Cheryl Smith filed suit against Winn-Dixie Stores Leasing LLC in the 24th Judicial District Court on Nov. 14.

Smith claims that on June 7, 2014 she was walking through the aisles of the Winn-Dixie located at 3645 LaPalco Blvd. in Harvey when she slipped on an unknown substance that was spilled in her pathway and fell to the floor. The plaintiff alleges she received injuries, including a herniated disc, back strain, leg injury, knee strain and mental anguish.

The defendant is accused of allowing an unreasonable dangerous condition in its store’s aisles, creating an unreasonably dangerous condition in the aisles of its stores, failing to correct a hazard, failing to inspect and monitor its store and failing to act with reasonable care and prudence.

An unspecified amount in damages is sought for medical costs, loss of wages, loss of wage earning capacity, pain and suffering, residual disabilities, mental anguish and emotional upset and distress.

Smith is represented by attorney Kevin M. Riley of New Orleans.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
