Pharmacy sued for man’s overdose on narcotic painkillers

GRETNA – A local pharmacy is being sued by a man who claims he was provided a higher dose of a narcotic pain killer than prescribed that resulted in him overdosing and suffering severe injuries.

Sidney Boudreaux, individually and on behalf of his minor son, filed suit against Folse Pharmacy Inc. in the 24th Judicial District Court on Dec. 22, 2014.

Boudreaux alleges that he was under the care of a local doctor for neck and shoulder pain who provided him with a perspiration for Oxycodone 15 mg. The plaintiff contends that he went to Folse Pharmacy Inc. located at 4000 4th St. in Marrero on June 5, 2103 to fill the prescription and was accidentally given Oxycodone 30 mg instead. Boudreaux asserts that he did not know that he had received the wrong pills and as a result took the medication and overdosed which required him to be transported to West Jefferson Medical Center. The plaintiff claims that he suffered from severe and permanent injury and illness due to the overdose.

The defendant is accused of pharmacy malpractice, negligently filling a prescription with the incorrect dosage, failing to implement and enforce protocol to prevent the supply of higher concentrated medications than prescribed, negligently filling a prescription and leading the plaintiff to believe the prescription had been properly filled.

An unspecified amount in damages is sought for physical pain and suffering, emotional pain and suffering, disfigurement, loss of enjoyment of life, cognitive loss, medical care expenses, life care expenses, loss of earnings and loss of earning capacity.

Boudreaux is represented by Zachary R. Christiansen of New Orleans-based The Bowling Firm APLC.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.
