Brother's sued over customer’s alleged slip and fall after pumping gas

GRETNA – A local gas station is being sued by a customer who claims she tripped in its parking lot over a raised cover that was embedded in the concrete.

Deborah A. Cassidey filed suit against Brothers I-10 Service Road Inc., Brothers Xpress Food Mart and their insurer in the 24th Judicial District Court on Dec. 23, 2014.

Cassidey contends that on Dec. 23, 2013 she was at a Bothers Xpress Food Mart and had just finished pumping gas and was walking toward a gas station when she tripped and fell over a raised metal cap embedded in the ground. The plaintiff asserts that she was violently thrown to the concrete in the incident and consequently received severe injuries.

The defendant is accused of failing to provide a safe environment for patrons, failing to warn of unsafe conditions and failing to properly maintain the premises.

An unspecified amount in damages is sought for medical expenses, mental pain and suffering, physical pain and suffering and loss of wages.

Cassidey is represented by attorney Tim L. Fields of New Orleans.

The case has been assigned to Division O Judge Danyelle M. Taylor.
