City of Kenner sued by hospital over land dispute dating back to 1985

GRETNA – A local hospital is suing the City of Kenner for allegedly taking its land for a public works project without providing proper compensation.

St. Theresa Hospital of Kenner LLC and St. Jude Hospital of Kenner LA LLC filed suit the City of Kenner against in the 24th Judicial District Court on Dec. 30.

St. Theresa Hospital of Kenner claims that the City of Kenner constructed water main pipes in 1985 adjacent to property it owns on W. Esplanade Avenue in Kenner. The plaintiff alleges that when the defendant constructed the public utility pipes it failed to create a servitude and did not provide the plaintiff with any compensation.

St. Theresa Hospital of Kenner contends that taking its land without compensation constitutes a violation of the Fifth Amendment to the United States Constitution regarding just compensation for eminent domain land takings.

Damages in excess of $75,000 are sought by the plaintiff.

St. Theresa Hospital of Kenner is represented by Kurt C. Garcia of the Kenner-based Garcia Law Firm LLC.

The case has been assigned to Division E Judge John J. Molaison Jr.
