Gas station sued by product distributor for over $73K

GRETNA – A local gas station and its owners are being sued by a distributor who claims it is owed more than $73,000 for goods sold on credit.

Frank Silva and Sons LLC filed suit against Bobby Brothers Inc. and Fremaux Texaco in the 24th Judicial District Court on Dec. 30, 2014.

Frank Silva and Sons alleges that on numerous occasions Bobby Brothers Inc. and Fremaux Texaco placed orders for goods including tobacco products, grocery items, dry goods and other products for sale at a convenience store at 7272 Fremaux Ave. in Slidell. The plaintiffs contend that the defendants accepted invoices when they received shipments of goods acknowledging delivery and that eventually those invoices amounted to $74,813.15.

However, Frank Silva and Sons asserts that the defendants have failed to make payments on their open account.

The defendant is accused of breach of contract.

Damages in the amount of $74,813.15 plus attorneys fees are sought by the plaintiff.

Frank Silva and Sons is represented by Kevin F. Truxillo of New Orleans-based Garrison, Yount, Forte & Mulcahy LLC.

The case has been assigned to Division E Judge John J. Molaison Jr.
