GRETNA – A local medical facility is being sued by a patient who claims she was grievously injured when a wind gust from a door being shut caused a window treatment to fall on her head.
Yvette Hilton filed suit against Access Health Louisiana, Hospital Services of Louisiana Inc. and two unknown men in the 24th Judicial District Court on Jan. 7.
Hilton alleges that she was a patient at the Belle Chasse Community Health Center, which is owned by Access Health Louisiana, on Jan. 30, 2014. The plaintiff contends she was in the clinic waiting room when another patient entered the office and a gust of wind caused by the door closing caused a window treatment to fall and strike her. Hilton asserts that she received severe and debilitating injuries in the incident including injuries to her head, shoulder, neck and back.
The defendant is accused of creating and maintaining a hazard, failing to maintain the premises, failing to properly install and inspect the window valance, failing to exercise reasonable care, failing to know what should have been known, failing to see what should have been seen and failing to remedy an unreasonable risk of harm.
An unspecified amount in damages is sought for pain and suffering, medical expenses and lost wages.
