Winn-Dixie sued by man alleging injuries from fall in bathroom

GRETNA – A local grocery store is being sued by a man who alleges he was severely injured in a fall in its bathroom.

Harry T. Begg III filed suit against Winn-Dixie Montgomery LLC in the 24th Judicial District Court on Jan. 9.

Begg claims that on Jan. 13, 2014 he was a customer at the Winn-Dixie grocery store located at 211 Veterans Memorial Blvd. in Metairie when he went to use the restroom. The plaintiff alleges that when he entered the restroom that he slipped and fell on a slippery, wet substance and was severely injured. Begg contends he received injuries to his head, neck and back in the incident.

The defendant is accused of failing to warn of hazards, failing to keep the bathroom floor clean, failing to provide a safe environment, failing to properly inspect the bathroom, failing to maintain its property and not correcting a defect.

An unspecified amount in damages is sought for medical bills, physical pain and suffering, mental pain and anguish and medical expenses.

Begg is represented by Sean Early of New Orleans-based Klutz & Early.

The case has been assigned to Division J Judge Stephen C. Grefer.
