Spirit Airlines and flight attendant sued after soda can fell on passenger's head

NEW ORLEANS – A New Orleans woman is suing Spirit Airlines and a flight attendant who allegedly dropped a full can of soda on her head, causing personal injuries.

Cheri Moore filed suit against Spirit Airlines Inc., and an unnamed flight attendant, in the Orleans Parish District Civil Court on Jan. 20, 2015.

The plaintiff claims that she was on a flight from Dallas to New Orleans when the defendant dropped a full can of soda directly onto the plaintiff's head. Moore also states that this injury has resulted in neck pain, severe headaches, and serious sleep problems. The plaintiff asserts that the flight attendant's inattentiveness and reckless manner negligently caused her injuries.

Moore also claims negligence on the part of Spirit Airlines in failing to properly supervise and train the flight attendant.

The plaintiff seeks an unspecified amount in damages for mental and physical suffering, medical expenses and lost wages.

The plaintiff is represented by Anthony Irpino and J. Benjamin Avin of New Orleans-based Irpino Law Firm.

This case has been assigned to Division N Judge Ethel S. Julien.
