Hair stylist accused of breaching non-compete clause, sued by former employer

GRETNA – A Metairie hair salon has sued one of its former stylists for allegedly breaching a non-compete agreement.

H2O Hair Inc. and H2O Salon & Spa filed suit against Nicole Michael in the 24th Judicial District Court on Feb. 3.

The plaintiff alleges that on Sept. 8, 2005 Michael signed a non-competitor agreement with H2O that was to last two years following her departure. Thus H2O Hair Inc. and H2O Salon & Spa assert that after the defendant’s last day on July 19, 2014 the non-compete agreement was in effect until July 19, 2016 during which time she was disallowed from opening, operating or being employed by a competing salon.

However, the plaintiff asserts that after Michael’s employment ended she breached her non-compete agreement by offering the same business services at Essential Salon and Nail Spa. H2O Hair Inc. and H2O Salon & Spa claim they are eligible to receive all earnings, profits and tips the defendant has earned through her breach of the non-compete agreement.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for loss of profits, impairment of goodwill and impairment of business reputation.

H2O Hair Inc. and H2O Salon & Spa is represented by Kenneth C. Fonte of Metairie-based Golden & Fonte.

The case has been assigned to Division D Judge Scott U. Schlegel.
