Louisiana Citizen Property Insurance Corporation sued by restaurant for alleged violation of state law

GRETNA – A property insurer is being sued by a local restaurant for allegedly failing to cover damages to the business by a hailstorm.

Universal Cafe LLC and Dragon Palace Restaurant filed suit against Louisiana Citizen Property Insurance Corporation in the 24th Judicial District Court on Feb. 20.

Universal Cafe and Dragon Palace Restaurant contend they own a property located at 4960 Lapalco Blvd. in Marrero that was insured by Louisiana Citizen Property Insurance Corporation when a hailstorm struck the area on Feb. 24, 2013. The plaintiffs asserts that in the hailstorm their property received substantial damage, but that the defendant did not provide an estimate on the damage until April 29, 2013 and in violation of state law failed to make a written offer to settle the claim within 30 days of the damage.

Universal Cafe and Dragon Palace Restaurant claims it is entitled to penalties in the amount of 50 percent of the total claim in addition to the amount of damages sustained in the incident itself.

The defendant is accused of breach of contract, breach of good faith and violation of state law.

An unspecified amount in damages is by the plaintiff.

Universal Cafe and Dragon Palace Restaurant are represented by attorney R. Ray Orrill Jr. of New Orleans.

The case has been assigned to Division B Judge Cornelius E. Regan.
