Metairie salon sues former employee alleging breach of non-compete clause in contract

GRETNA – A salon and spa is suing a former employee who allegedly breached a non-compete clause in her employment contract by working for a competitor before a two year period had elapsed.

H2O Hair Inc. and H2O Salon & Spa filed suit against Alison Kennedy in the 24th Judicial District Court on Feb. 5.

H2O claims that on Jan. 20, 2017 Kennedy entered into an employment contract with them to work at their salon located in Jefferson Parish. The plaintiff alleges that under the defendant’s contract she was not to work for a competing salon until two years after her employment ended. However, H2O contends that after Kennedy left she began working for another salon in Jefferson Parish and solicited H2O’s clients.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for the full amount of her earnings and profits as a result of the breach, loss of profits, impairment of business and impairment of business reputation.

The plaintiff is represented by Kenneth C. Fonte of Metairie-based Golden & Fonte.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.
