Deckhand cites negligence in fall off vessel

A Terrebonne Parish man has sued a maritime business, alleging negligence in a 2014 accident.

Israe Domangue filed a complaint April 21 in U.S. District Court of the Eastern District of Louisiana against Louisiana Delta Marine of Metairie, citing workplace negligence and/or gross negligence.

According to the suit, on June 18, 2014, Domangue tripped on wires and fell off a marine vessel onto a facing barge while at work. He cites the defendant with failing to: maintain the vessel and its equipment in a safe state of repair; take precautions for the plaintiff’s safety; provide a safe workplace, and warn him of existing hazards.

In addition to citing serious and debilitating injuries, Domangue also alleges willful breach of duty via delayed compensation benefits. The complainant states he has not reached maximum medical improvement, and his condition has further been aggravated by the delay.

The plaintiff cites physical pain and suffering, mental anguish, lost wages and earning capacity, disfigurement, impairment and medical expenses.

Domangue seeks compensatory and punitive damages plus attorney fees, expenses and costs.
