Flowers Baking company employees file suit over $92K commission dispute

NEW ORLEANS – Employees of Flowers Baking company claim a 10 percent commission cut since June of 2013 has deprived them of $92,000.

Gordon Frank, Ryan Skaggs, Julian Penisson, Henri Bourg (Tray), John Michael Meche, Omar Ziadeh, Patrick Belton Jr., Michael Aymond, Bernard Gilliam, Ronald L. Gardet Sr., Jerry D. Bell, Nathaniel Jackson and Ronald Joachim filed suit against Flowers Baking Company of New Orleans LLC.

The plaintiffs contend Flowers Baking annually publishes “pay scales for their distributors” via percentage points. However, beginning in 2013 this number was allegedly deflated to 10 percent commission for “restaurant items.” Previously it was 20 percent commission for restaurant items, the suit says.

The plaintiffs demand unpaid commissions owed since June 2013. The defendant, Flowers Baking, has allegedly responded by only sending a single offer of “four weeks of said commission” to the petitioners.

The plaintiffs are represented by attorney Melvin Ripp Jr.

The case has been assigned to Div. I Judge Piper D. Griffin.
