An Orleans Parish woman has sued two businesses, alleging negligence in a 2014 road accident.
Kelly Mendoza filed a lawsuit April 21 in U.S. District Court of the Eastern District of Louisiana against LaFarge North America Inc. and National Union Fire Insurance Company of Pittsburgh, citing liability in a 2014 motor vehicle accident.
According to the suit, on Oct. 24, 2014, a cement mixer-truck owned by LaFarge and insured by National Union collided with the Mendoza's vehicle on Jefferson Davis Parkway in Orleans Parish. Mendoza incurred injuries requiring surgery along with total damages to her vehicle, the suit states.
The suit alleges failure of the driver to stay in his lane, turn properly to avoid a broadside collision, and maintain a proper lookout. Mendoza cites the defendant, LaFarge, with negligence in failing to train its employee.
The plaintiff cites: physical pain and suffering; extreme mental anguish and post-traumatic stress; permanent impairment and disfigurement; lost wages and earning capacity; and medical expenses.
Mendoza seeks compensatory damages exceeding $75,000, plus attorney fees, expenses and costs.
