GRETNA – A woman is suing a local retailer and a food manufacturer responsible for stocking shelves after she slipped and fell on loose chips on the floor.
Tammy Orgeron filed suit against Wal-Mart Stores Inc., Frito-Lay North America Inc., Old Frito Lay Inc. and Rolling Frito-Lay Sales LP in the 24th Judicial District Court on March 26.
Orgeron claims she was shopping at the Wal-Mart located at 3265 Manhattan Blvd. in Harvey when she slipped on loose Frito-Lay chips that were on the store’s floor and fell to the ground. The plaintiff alleges Frito-Lay was in charge of stocking chips in the store and their negligence in part resulted in her slip and fall. Orgeron contends she was severely injured in the incident.
The defendant is accused of failing to safely maintain the premises, failing to take necessary measures to protect visitors, failing to properly maintain and supervise the premises, failing to warn visitors, failing to take steps to avoid the incident and improper stocking.
An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, medical expenses, loss of enjoyment of life, permanent disability, loss of consortium and attorney’s fees.

The case has been assigned to Division J Judge Stephen C. Grefer.
