GRETNA – A construction company is being sued by the City of Gretna for allegedly destabilizing a canal while working on it.
The City of Gretna filed suit against the State of Louisiana throughout the Department of Transportation and Development and Command Construction LLC in the 24th Judicial District Court on March 27.
The City of Gretna contends that in April 2014 Command Construction began performing work on a canal, including dredging, re-sloping and inserting sheet piling into the canal’s banks, located between the lanes of Stumpf Boulevard and the Westbank Expressway in Gretna.
The plaintiff asserts that that staging area the defendants used for their work, located on Stumpf, was damaged during the course of a construction project and that part of the work was completed on property owned by the City of Gretna without its express permission being granted. The City of Gretna claims the damage to the area resulted in erosion to the canal that had the effect of destabilizing adjacent roads and may cause the collapse of portions of Stumpf in the future. The City of Gretna alleges the defendants have failed to respond to its demand to fix the problem.
The defendant is accused of property damage and violating the City of Gretna’s constitutional rights by taking and damaging their land without compensation.
An unspecified amount in damages is sought by the plaintiff.

The case has been assigned to Division C Judge June Berry Darensburg.
