Subcontractors sue construction company, New Orleans claiming breach of contract

NEW ORLEANS – A subcontractor who worked with the City of New Orleans in the construction of the St. Roch Market is suing for allegedly not being paid in a timely manner for its work.

Juneau Odenwald, Inc. filed suit against The Lathan Company, Inc., The City of New Orleans, and The Guarantee Company of North America USA in the Orleans Parish Civil District Court on May 21

The suit says that defendant Lathan Company entered into a construction contract with the City of New Orleans for a project known as the St. Roch Market at 2381 St. Claude Ave. in 2014. Lathan then entered into a subcontract with the plaintiff for specific portions of the project's work including roofing and sheet metal. The plaintiff claims that all of the agreed-upon work was completed in a timely and professional manner. The plaintiff invoiced Lathan for the work performed but the defendant has allegedly failed to pay $6,535.00.

The defendant is accused of breaching its contract by refusing to pay the plaintiff for completed work.

The plaintiff is seeking the full amount of the balance due, plus interest, attorney fees, costs in the prosecution of this lawsuit and other damages as allowed by law.

The plaintiff is represented by Wayne J. Jablonowski of the Law Office of Wayne J. Jablonowski, APLC.

This case has been assigned to Division N Judge Ethel S. Julien.
